Microsoft's New Kinect: Much More Than Mere Motion Control

I hope you like motion control because it ain't going nowhere. Microsoft just announced its new Kinect and though it's not literally wired into the Xbox One, it'll be coming with every One sold. But this time, Kinect is less about about gaming, and more about media than ever.

Kinect has always had voice control built in, but now Microsoft is pressing it harder than ever. Virtually everything on the Xbox One can be controlled by voice, thanks to the Kinect's ears. Its eyes factor in too, letting users perform subtle hand gestures while sitting down (!!!) to control the interface without any controller in sight.

Kinect also behaves as the control hub for your whole Xbox One experience. When you sit down on the couch with your controller in your hand, Kinect will take note, and turn your system on for you. Creepy, but awesome.

Kinect's innards are beefier than ever. Its new sensors can not only pick up on all your joints, and model your body, extrapolating things like your balance, and even figuring out your heartbeat from just staring at you. That last bit alone means its camera must be damned serious. It can pick up video at 60 FPS in 1080p, and has a field of view that's 60 percent bigger than the old Kinect's.

And this time, Kinect is outfitted with a modulated IR beam and "time-of-flight," radar-esque tech that tracks the time it takes photons to bounce off the room in front of it. That should do away with the pesky lighting issues that plagued the original Kinect. The new Kinect should work in complete darkness, if you're into that.

From a practical perspective the new Kinect will doubtlessly be able to see little things like faces, and open versus closed hands, instead of guessing along with what vague body-shapes it can make out. And it'll have to if it wants to go toe-to-toe with the Playstation 4 Eye, which boasts 1280x800, Kinect-style body tracking, an 85-degree field of view, and works with accessories (including the DualShock 4 controller) as well as on its own.

All that said, the first Kinect looked pretty damned impressive when it was first shown off, and then it turned out to be not nearly as awesome (or functional) in the wild. Microsoft has doubtlessly learned a lot from the experience though, and they're betting big big big on their whole "you are the controller thing" so hopefully that means some genuinely awesome motion control gaming this time around. And even if not, the comprehensive media control makes Kinect way more than some peripheral. Not like you've got a choice of whether or not you want one anyway.

'The myth of suburban prosperity'

LOS ANGELES (AP) ? More poor people live in the nation's suburbs than in urban cities because of affordable housing, service-sector jobs and the increased use of housing vouchers, according to a study released Monday.

The number of those in poverty living in suburbs jumped 67 percent between 2000 and 2011, a much larger increase than in cities, researchers for the Brookings Institution said. Suburbs, however, still have a smaller percentage of the poor than cities do.

The report notes that poor people were pulled to the suburbs by more affordable homes and followed jobs that were often low paying. But those who moved to the suburbs also saw manufacturing jobs disappear and housing prices plummet following the economic recession.

"The myth of suburban prosperity has been a stubborn one," Christopher Niedt, academic director of the National Center for Suburban Studies at Hofstra University, told the Los Angeles Times (http://lat.ms/12FKPNm ). Even as suburban poverty emerged, "many poorer communities were so segregated from the wealthy in suburbs that many people were able to ignore it."

Suburban cities have been ill equipped to handle the surge. In Irvine, the nonprofit Families Forward use to hand groceries to about 25 families every week; now it's more than 160. The estimated number of poor people in Irvine rose from more than 12,000 to nearly 21,000 in a decade, Brookings found.

"Everything is nicely maintained. Things look good on the surface," said Margie Wakeham, executive director of Families Forward. "But the need has just skyrocketed."

The newspaper said poverty shifted to the suburbs earlier in Los Angeles than nationwide. About half of the poor in Los Angeles, Long Beach, Santa Ana and their outskirts have lived in suburbia for decades, according to Brookings' analysis. That percentage rose to 53.4 in 2011.

The report also shows a slight increase in New York City suburban poverty.

Stocks mixed in slow start to week

Stocks?fluctuated between small gains and losses on Wall Street for most of Monday. Small-company stocks?are doing well because they are less exposed to recession-plagued Europe than the large international stocks that make up the Dow and the S&P 500 index.

The Russell 2000, an index of small-company?stocks, climbed above 1,000 points for the first time and ended higher Monday, even as the Dow Jones industrial average, the Standard & Poor's 500 index and the Nasdaq composite index all edged lower.

Small?stocks?are doing well because they are more focused on the U.S., which is recovering, and are less exposed to recession-plagued Europe than the large international companies that make up the Dow and the S&P 500 index.

The gains for the smaller companies are encouraging for the broader?stock?market because they show that investors are becoming more comfortable about the economy and investing in riskier assets, said Rob Lutts, Chief Investment Officer at Cabot Money Management.

Small-company?stocks?are considered riskier than the?stocks?of well-established, large companies like IBM or Coca-Cola. That's because small companies are often relatively young and tend to have less diversified businesses than larger ones, making them more susceptible to swings in demand from their customers. There are also fewer buyers and sellers for them, which can make the?stocks?harder to off-load if prices start to fall.

"Having smaller?stocks?hit new highs means that the rally is broad," Lutts said. "It gives us a little more confidence that it's a good, sustainable rally that can hold together for a while."

The Russell 2000 ended the day 1.70 points, or 0.2 percent, higher at 997.98. The index climbed as high as 1001.50 at midday. The index is 17.5 percent higher for the year, a better performance than better-known market barometers like the Dow and S&P.

Major indexes fluctuated between small gains and losses for most of Monday. On Friday they ended at record levels after four straight weeks of gains.

The Dow closed down 19.12 points, or 0.1 percent, at 15,335.28, paring its gain for the year to 17 percent. The S&P 500 index fell 1.18 points, or 0.1 percent, to 1,666.29. Its advance for the year now stands at 16.8 percent.

Investors are focusing on the Federal Reserve this week and looking for clues about what it plans to do next with its economic stimulus program. On Wednesday Fed Chairman Ben Bernanke will appear before Congress and the central bank will release minutes of its most recent policy meeting.

The Fed is buying $85 billion of bonds every month to keep long-term interest rates low. That has encouraged investors to put money into?stocks?instead of bonds. The yield on the 10-year Treasury note has been below 2 percent almost continually since April 12. That's less than many large companies pay in dividends.

Policy makers are unlikely to cut back on stimulus just yet since U.S. economic growth is likely to slow in the second quarter, said Scott Wren, a senior equity strategist at Wells Fargo Advisors. As a consequence, Wren said,?stocks?are likely to continue to rise.

"At some point, we will see some sort of a pullback, but it doesn't seem like it's going to be right now," said Wren. "In the near term we're probably going to trade a little bit higher."

The?stock?market rally is also is being underpinned by investors moving back into?stocks, reversing years of outflows of funds from equity markets, said Jerry Braakman, chief investment officer at First American Trust.

Investors have invested about net $17 billion into domesticstock?mutual funds since the start of the year, according to data from the Investment Company Institute. Investors have pulled money out of mutual funds every year since the beginning of the financial crisis in 2007.

"This market rally still has legs, partly because we've seen huge retail inflows back into equities," Braakman said. "It's hard to beat the money flow."

In commodities trading, the price of crude oil rose 69 cents, or 0.7 percent, to $96.71 a barrel.

The price of gold rose for the first day in eight as the dollar fell. The precious metal climbed $19.40, or 1.4 percent, to $1,384. Gold has slumped this month as its attraction as an alternative investment fades as the dollar appreciates.

The U.S. currency is strengthening because investors believe the U.S. economy is in better shape than the Japanese or European economies.

The dollar's rally paused on Monday, though, and the U.S. currency fell against the euro and the yen. The dollar index also dropped, after climbing to its highest level in close to three years Friday.

In U.S. government bond trading, the yield on the 10-year Treasury note rose to 1.97 percent from 1.93 percent.

The Nasdaq composite index fell 2.53 points, or 0.1 percent, to 3,496.43 points.

Among?stocks?in focus on Monday:

? Actavis rose $1.65, or 1.3 percent, to $127.15 after the pharmaceutical company said it's buying Warner Chilcott. The all-stock deal, valued at $8.5 billion, would create the third-biggest specialty pharmaceutical company in the U.S.

? Chesapeake Energy rose 53 cents, or 2.6 percent, to $20.80 after the natural gas producer named Anadarko Petroleum executive Robert Douglas Lawler as its new CEO. He takes over as Chesapeake continues selling assets to pare down an enormous debt burden.

?Websense, an internet security firm, surged $5.53, or 29 percent, to $24.76 after the company agreed to be taken private for $906 million by private equity firm Vista Equity Partners.

AP CEO calls records seizure unconstitutional

(AP) ? The president and CEO of The Associated Press says the government's seizure of AP journalists' phone records was "unconstitutional" and already has had a chilling effect on newsgathering.

Gary Pruitt says the Justice Department's secret subpoena of reporters' phone records has made sources less willing to talk to AP journalists.

The Justice Department disclosed the seizure of two months of phone records in a letter the AP received May 10. The letter did not state a reason, but prosecutors had said they were conducting a leaks investigation into how the AP learned about an al-Qaida bomb plot in Yemen before it was made public last year. Pruitt said the AP story contradicted the government's claim at the time there was no terrorist plot.

Pruitt spoke on CBS' "Face the Nation."

Senators work through changes to immigration bill

WASHINGTON (AP) -- Senators working on a wide-ranging immigration bill have agreed to tighten controls on the asylum system that allows people fleeing war or persecution to find refuge in the U.S.

Republican Sen. Lindsey Graham of South Carolina offered the amendment, which would terminate asylum or refugee status for anyone who returns home to the country they fled, unless they can show a good reason for doing so.

Graham said the change was merited in light of the Boston Marathon bombings. The brothers who allegedly set off the bombs arrived in the U.S. as boys when their family sought asylum here.

The amendment was approved on voice vote Monday as the Senate Judiciary Committee entered its third week of weighing amendments to a bipartisan immigration bill.

Tea party looks to take advantage of moment

DES MOINES, Iowa (AP) ? Is the tea party getting its groove back? Shouts of vindication from around the country suggest the movement's leaders certainly think so.

They say the IRS acknowledgement that it had targeted their groups for extra scrutiny ? a claim that tea party activists had made for years ? is helping pump new energy into the coalition. And they are trying to use that development, along with the ongoing controversy over the Benghazi, Libya, terrorist attacks and the Justice Department's secret seizure of journalists' phone records, to recruit new activists incensed about government overreach.

"This is the defining moment to say 'I told you so,' " said Katrina Pierson, a Dallas-based tea party leader, who traveled to Washington last week as the three political headaches for President Barack Obama unfolded.

Luke Rogonjich, a tea party leader in Phoenix, called the trio of controversies a powerful confluence that bolsters the GOP's case against big government. "Suddenly, there are a lot of things pressing on the dam," said Rogonjich.

It's unclear whether a movement made up of disparate grassroots groups with no central body can take advantage of the moment and leverage it to grow stronger after a sub-par showing in last fall's election had called into question the movement's lasting impact. Republicans and Democrats alike say the tea party runs the risk of going too far in its criticism, which could once again open the door to Democratic efforts to paint it as an extreme arm of the GOP.

"Never underestimate the tea party's ability to overplay its hand," said Democratic strategist Mo Elleithee. "Just because there is universal agreement that the IRS went too far, that should not be misread as acceptance of the tea party's ideology of anger."

At the very least, furor over the IRS devoting special attention to tea party groups claiming tax-exempt status is giving the tea party more visibility than it has had in months, and it's providing a new rallying cry for tea party organizers starting to plot how to influence the 2014 congressional elections. The law allows tax-exempt organizations to lobby and dabble in politics as long as their primary purpose is social welfare.

The tax-agency scandal ? it has led to the acting IRS commissioner's ouster, a criminal investigation and Capitol Hill hearings ? seems to validate the tea party's long-held belief among supporters that government was trampling on them specifically, a claim dismissed by ousted commissioner Steven T. Miller. He has called the targeting "a mistake and not an act of partisanship."

Nevertheless, Sen. Marco Rubio, R-Fla., elected in 2010 with tea party backing, said the IRS scandal "confirms many of the feelings that led to the tea party movement in the first place."

"What's happened here is a reminder of, this is what happens when you expand government," he said in an interview with The Associated Press. "That and the disaster that is Obamacare is going to be a real catalyst in 2014 and beyond."

Tea party activists hope they also can drive support ahead of the elections by stoking widespread suspicions that the Obama administration and State Department are hiding key details about the September 2012 attack in Benghazi, Libya, that killed the U.S. ambassador and three other Americans. The seizure of Associated Press phone records also plays into their argument that government is too intrusive.

Tea party activists have tried to take advantage of the issues that have put some of their central tenets ? limited government and civil liberties ? in the spotlight.

From around the country last week, they headed Washington to hold a news conference on the Capitol steps and meet with members of Congress. Those who stayed home jammed House and Senate phone lines with calls urging congressional action as the IRS saga unfolded. An email from Teaparty.org that was sent to activists proclaimed: "We've worked so hard these past few years and it's paying off! We're witnessing the unraveling of a presidency at an unprecedented rate."

Freedomworks, a national tea party group, spent the week circulating petitions for congressional hearings and encouraging leaders of local groups who believe they have been targeted by the IRS to include their story on a national database to build the case against the agency.

"Perhaps all this attention will break something loose," said Jim Chiodo, an activist from Holland, Mich.

It wasn't long ago that the tea party was the hot new political kid on the block, bursting onto the national scene during the contentious summer debate over health care in 2009. Over the next few years, the loosely affiliated conservatives and civil libertarians would leave their mark on the 2010 elections by helping Republican candidates win Senate races in Florida, Kentucky, Utah and Wisconsin and scores of House races.

Those victories resulted in House and Senate Republican caucuses getting pushed to the right in legislative battles, making life difficult for Obama and his Democrats in an era of divided government.

But the movement's success was muted in 2012 when Republicans nominated the establishment-backed Mitt Romney for president, though he did little to inspire the tea party. He lost, and so did many tea party-backed House and Senate candidates.

Now, tea party activists say they are emboldened and won't be afraid to recruit candidates to run in Republican primaries against incumbents who appear to go easy on the Obama administration, particularly in light of the IRS scandal.

"It's one of those issues we should just raise hell about," said Nashville Tea Party leader Ben Cunningham.

Some say they're now even more suspicious of government than before.

"I personally feel so vindicated," said Mark Falzon, a New Jersey tea party leader. But he added: "What's scaring me now is what's going on below the water line that we're not seeing."

Republicans say that the tea party will have an opportunity come 2014 to make its mark again, particularly with Obama not at the top of the ticket. Also, they say that with Obama's health care law going into effect and with the slew of latest controversies, they now have concrete issues to point to when arguing against government overreach.

"Suddenly, this is a very real demonstration of too much power ceded to government bureaucrats," said Matt Kibbe, president of Freedomworks. "This is no longer theoretical."

Accessible by tapping the Stitcher logo at the top of the screen, car mode offers a pared-down version of the app's standard UI, with bigger buttons and only the essential audio controls. It's nowhere near as flashy as Stitcher's BMW integration, mind you, but the point is to keep your eyes on the road and off your iPhone's screen. The app gets a few other updates this time around: a front page with top headlines, one-tap access to shows and podcasts you're searching for and improved playback when you're picking up in the middle of a show. Obama Student Loan Policy Under Scrutiny As Congress Tackles ...

WASHINGTON -- Congressional Democrats have pounced on a nonpartisan government report showing the Department of Education this year is forecast to earn a record $51 billion profit off student borrowers, denouncing the Obama administration and urging for structural reforms.

Members of the House of Representatives including George Miller (D-Calif.), John Tierney (D-Mass.) and John Yarmuth (D-Ky.) cited news reports in The Huffington Post that highlighted the Tuesday estimate by the Congressional Budget Office, which showed that the Education Department was forecast to report higher earnings this year than Exxon Mobil and nearly as high as those of the four biggest U.S. banks by assets combined.

"We don't see students or their parents as profit centers, and we don't think it's an appropriate concept to be acting like a market-driven bank here," Tierney said.

Miller criticized a policy that is leading to "immense profit being extracted from students and families that are struggling."

The critical comments have alarmed policymakers in the Obama administration, who along with lawmakers are racing to avert a scheduled doubling of interest rates on some new federal student loans that is set to occur on July 1.

Miller said the CBO report ?totally changed the conversation around here.? On Wednesday, the Republican National Committee tweeted a link to the HuffPost story to its more than 213,000 followers.

Tierney said the profit figure prompted him to meet with Under Secretary of Education Martha Kanter and other agency officials to discuss the issue.

The House Education Committee on Thursday approved Republican-led legislation that would tie student loan interest rates to the U.S. government?s borrowing costs. Two Democrats voted for the bill. The full House is expected to vote on the measure soon, as rates on subsidized Stafford loans for future borrowers are scheduled to double to 6.8 percent.

?While we welcome action by the House on student loans, we have concerns," the White House said in a statement.

Some Republican senators have introduced similar legislation, as has the White House. President Barack Obama?s plan, however, features lower rates than the House Republicans? plan, though unlike the Republicans? plan it does not cap interest rates in case the U.S. government?s borrowing costs rapidly increase.

The president's plan would expand a program signed into law by George W. Bush that would tie monthly repayments of federal student debt to borrowers? income. That part of Obama?s proposal was not seriously pursued during the education committee meeting.

Leading Republican and Democratic bills do little for current borrowers, potentially worrying financial regulators. The Consumer Financial Protection Bureau, for example, has warned that the cumulative $1.1 trillion in outstanding debt carried by today?s borrowers may impede economic growth.

Most Democrats slammed the Republican bill during the education committee meeting. They claimed a report from the Congressional Research Service showed the Republican measure would lead to higher borrowing costs for students and their families than current law.

The CRS report, however, assumes that the U.S. government?s cost to borrow for a 10-year term will more than double in three years.

Virginia Foxx (R-N.C.), one of the cosponsors of the House Republican measure, said: ?This legislation offers predictability, simplicity, and will ensure interest rates are immediately in line with the free market -- a need particularly acute in today?s jobless economy.?

Miller, who for years has tried to lower college borrowing costs for households, said policymakers need to revamp the federal student loan program. Roughly three-fourths of all federal student loan dollars disbursed this year carry interest rates of either 6.8 or 7.9 percent. A quarter of them carry 3.4 percent interest, according to Education Department budget documents.

The rates are fixed by Congress, though they have not been updated to reflect the present near-record low interest rate environment. For example, when Congress set the rates in 2007, the average new 30-year, fixed-rate mortgage could be had for about 6.3 percent, according to Freddie Mac, the government-backed mortgage financier. The average new 30-year, fixed-rate mortgage now carries a 3.5 percent interest rate.

The increasing gap between what students and families pay to finance a college education and what the U.S. government pays to borrow has led to record profits for the Treasury.

?This profit that's being squirreled away at the expense of families and students -- you have to ask, is there a better use for that money?? Miller said.

He added: ?We have to think about modernizing the program and making it relevant for students and taxpayers. This current model has run out of gas. We?re getting less and less return.?

Miller is pushing for legislation that would feature substantially lower interest rates and debt forgiveness for struggling borrowers. Such a bill ?may be a better fix for this economy, this country and our future," he said.

While "Jimmy Kimmel Live" isn't necessarily known for its sweet approach to babies or children (Kimmel routinely exhorts parents to prank their kids and capture it on camera for yuks), on Thursday night he managed to blend a spoof of "The Bachelor/The Bachelorette" with a clutch of toddler actors that was, well, downright adorable.

In a spoof of the long-running ABC reality series "The Bachelor," Kimmel lent his voice to a "preview" of a "new" series, "The Baby Bachelor," in which Wesley, a very young man just looking for a play date has to choose between a collection of similarly youthful ladies. Federal report documents inmate sex abuse in US

INDIANAPOLIS (AP) ? Inmates at jails in Indianapolis, Baltimore, St. Louis and Philadelphia face the nation's highest levels of sexual abuse at the hands of guards, according to a new federal report based on surveys of inmates at U.S. jails and prisons.

The report by the U.S. Department of Justice found that the Marion County Jail's inmate-intake center in Indianapolis had a 7.7 percent rate of staff sexual misconduct involving inmates ? the nation's highest for jails ? and well above the average 1.8 percent sex abuse rate among all jails surveyed.

The second-highest rate was among inmates surveyed at the Baltimore City Detention Center, where a 6.7 percent rate of sex abuse by guards was found based on inmate interviews. The St. Louis Medium Security Institution and the Philadelphia City Industrial Correctional Center had the next-highest rate ? both with a 6.3 percent abuse rate, based on the inmate surveys.

The main jail for Santa Clara County in California was the next highest, with a 6.2 percent sex abuse rate, the report found.

The new report, the third of its kind by the Justice Department, was based on interviews with inmates between February 2011 and May 2012.

Kevin Murray, an attorney for the Marion County Sheriff's Office, told The Indianapolis Star that he questions the report's sample size of 62 inmates interviewed at Indianapolis' inmate-intake center. He said he had received no complaints about sexual abuse during the year in which the survey was taken.

"This survey is very suspect. We didn't receive any grievances, and we haven't been sued for anything that happened then," Murray told the newspaper.

Allen Beck, a Justice Department statistician who authored the study, said five of the 62 inmates interviewed reported sexual abuse by guards.

"That's a big number: five out of 62," he told the Star.

Amy Fettig, senior staff counsel for the American Civil Liberties Union's Prisoner Project in Washington, D.C., told the newspaper that there was nothing wrong with the Justice Department's methodology.

"They've got a lot of expertise on this," she said.

The report's authors surveyed 233 prisons, 358 local jails and 15 special correctional facilities, including five military facilities and five jails within Indian tribal areas.

Among all of the facilities sampled, the highest staff sexual misconduct was reported by inmates at the Oglala Sioux Tribal Offenders Facility in South Dakota, where there was a 10.8 percent sexual abuse rate.

That facility had a peak population of 147 inmates in June 2011 and was the most crowded among the 80 Indian incarceration facilities in operation at mid-year 2011, the report states.

Acting IRS head apologizes, blames 'foolish mistakes' for targeting of conservative groups

The outgoing head of the IRS blamed ?foolish mistakes? made by employees for the agency?s targeting of conservative groups, denying that partisanship played a role in the controversy.

Steven Miller, the acting commissioner of the IRS who submitted his resignation from that role earlier this week, appeared on Friday before the first Capitol Hill hearing on the revelations that IRS officials had inappropriately singled out conservative groups for extra scrutiny. He apologized for the tax-collecting agency?s actions, but blamed incompetence, rather than political score-settling, for the scandal.

?As acting commissioner I want to apologize on behalf of the IRS for the mistakes that we made and the poor service that we provided,? he said in a brief opening statement.

?I do not believe that partisanship motivated the practices of the people described in the IG report,? Miller added. ?I think that what happened here was that foolish mistakes were made by people who were trying to be efficient in their work.?

House Republicans convened, on Friday, for the first of what?s sure to be many hearings into the actions by taken by IRS officials to single out conservative and Tea Party groups for additional scrutiny.

Miller appeared before the House committee charged with handling taxes on Friday, where he faced pointed questions from Republicans and Democrats alike.

The hearing comes a week after an inspector general?s reports detailing abuses by IRS officials first became public. The revelation that the IRS had targeted conservative groups seeking nonprofit status erupted this week into a major political controversy for President Barack Obama, who publicly denounced the actions of the IRS officials, and pledged to cooperate with Congress in investigating the root cause of the controversy.

?It is just simply unacceptable for there to even be a hint of partisanship or ideology when it comes to the application of our tax laws,? the president said Thursday at the White House.

But the administration?s actions have scarcely satisfied conservatives, who have demanded criminal prosecutions as a result of the controversy, and have suggested that the IRS?s actions might have been a politically motivated effort to target ideological opponents. (The inspector general report found no evidence of external influence on IRS field agents to pursue conservative groups.)

Sen. Marco Rubio, R-Fla., joins The Daily Rundown's Chuck Todd to talk about the IRS scandal. He discusses whether ?the IRS situation hurts chances of passing bipartisan immigration reform, Benghazi, and the gives his opinion on the new Media Shield Law.

Sen. Marco Rubio, R-Fla., who?s seen as possibly having his own presidential ambitions one day, called the IRS fiasco evidence of a ?culture of intimidation? by the Obama administration; House Speaker John Boehner, R-Ohio, accused the administration of ?remarkable arrogance? over the IRS controversy and revelations that the Justice Department seized phone records of Associated Press journalists.

Friday?s hearings before the House Ways and Means Committee will give Republicans a perch to advance many of those attacks on the administration. Along with Miller, J. Russell George, the Treasury?s inspector general for tax administration, will also appear.

?This committee wants the facts, and the American people deserve answers to why they were targeted on the basis of their political beliefs,? Rep. Dave Camp, R-Mich., the chairman of the committee, said following Miller?s resignation on Wednesday. ?The IRS has demonstrated a culture of cover up and has failed time and time again to be completely open and honest with the American people.?

Anna Lappe: Wendy's, What Are You Waiting For?: Calling on the Fast Food Giant to Stand up For Farmworkers

Who has freckles, pigtails, and is still holding out from joining the Fair Food Program? If you guessed the fresh-faced mascot of Wendy's, give yourself a gold star. As part of its efforts to improve conditions in the fields, the Coalition of Immokalee Workers, a group of farmworkers based in Florida, is calling on the fast food giant Wendy's to step up for farmworkers and their families.

The Coalition has had an impressive wave of wins as many companies -- eleven to date -- have signed an agreement to improve conditions for farmworkers. ?Of the top five fast food chains, McDonald's, Burger King, Subway, and Yum! Brands (owners of Taco Bell, Pizza Hut, KFC and A&W) have all joined the Fair Food Program. In response to pressure from the Coalition and its allies, the list has grown to include Chipotle, food retailers (Whole Foods, Trader Joe's), and food service companies (BAMCO, Aramark, Sodexo and Compass Group). The overwhelming majority of tomato growers now participate in this farmworker-driven commitment through the Florida Tomato Growers Exchange, which represents 90 percent of the industry.

By signing on to the agreement, companies must now comply with a code of conduct that includes protections for cases of wage theft, sexual harassment, and forced labor. Companies also agree to pay a small premium for tomatoes -- just a penny more per pound. As a result, workers have safer working conditions and have started seeing increases in their paychecks for the first time in more than 30 years.

Think a penny a pound doesn't sound like much? It adds up. Over $10 million has been paid out through these victories since January 2011. That number will only keep growing as more companies sign on.

Wendy's, of all companies, can afford paying this premium. One of the highest earning fast food chains in the country, Wendy's comes in at number two behind McDonald's. Nearly 6,600 restaurants in the U.S. and around the globe afford the company serious market power-- influence that can go a long way to shift purchasing practices. Instead of leveraging that power to demand lower prices from suppliers, Wendy's could be rewarding growers who respect workers' rights.

Other fast food companies have stepped up, like Taco Bell. The fast food giant was the first company to sign on to the Coalition agreement back in 2005, after four years of pressure and organizing. In its announcement, Taco Bell said:

"As an industry leader, we are pleased to lend our support to and work with the CIW to improve working and pay conditions for farmworkers in the Florida tomato fields... We recognize there is a need for reform... We hope others in the restaurant industry and supermarket retail trade will follow our leadership." - Emil Brolick, Taco Bell President (2005)

Brolick and Taco Bell showed that signing on to the agreement wouldn't threaten a company's bottom line. In fact, Brolick's tenure is credited with boosting sales and 'turning things around at Taco Bell. Proof that profits don't come at the expense of workers' rights.

Seven years later, Wendy's is still dragging its feet instead of following Taco Bell's example -- or more accurately Brolick's own example, since he has now taken over as CEO of Wendy's.

This week, as Wendy's convenes its annual shareholders' meeting in New York City, the Coalition is in town to make sure the company has its priorities straight.?On Saturday, May 18th, farmworkers and allies will march from Union Square to nearby Wendy's locations, reminding shareholders that farmworkers aren't an abstract budget line item, but hardworking women and men who deserve respect. (And, sure, to give Wendy's CEO Emil Brolick a dose of d?j? vu. He already has some experience with this, after all.)

Turkish Prime Minister Recep Tayyip Erdo?an allegedly invited a special personal guest to accompany him on his visit to the U.S. this week.

According to Turkish media, the father of one of the radical Islamist activists killed in Israel's raid on the Mavi Marmara in 2010 (the Gaza flotilla) was included as an invited guest in the prime minister's delegation in the hopes he might be able to meet President Barack Obama.

Furkan Do?an, a 19-year-old with both Turkish and U.S. citizenship, joined the Gaza flotilla where he expressed his desire for "martyrdom." His father now wants the U.S. government to sue Israel over the raid in which the IDF says its forces were defending themselves from what appeared to them to be an organized attack launched by passengers armed with knives and metal bars as the commandos boarded the ship.

Today's Zaman reports:

Ahmet Do?an, who asked Erdo?an to deliver a letter to US President Barack Obama, joined Erdo?an's delegation upon a request by the Turkish prime minister.

Do?an said Erdo?an told him: "I can give this letter [to him], but it is better if you give the letter to him yourself. I will include you among the members of the official delegation." Do?an also said the prime minister told him he should meet with Obama if they can arrange an appointment with him. The victim's father said he described Furkan and wrote about his son's life in the letter.

It's unknown if the father's letter was delivered to Obama or if he actually met the President during the trip. That the radical activist's father was with the prime minister's entourage was not addressed during the joint Obama-Erdo?an press conference Thursday or at the White House or State Department briefings of the past few days.

Furkan Do?an, along with eight Turkish activists, was killed in a battle with Israeli commandos who boarded the ship to enforce the naval blockade on Gaza, instituted after Palestinian terrorists were caught smuggling heavy weapons to the territory by ship.

Flotilla organizers claimed they were on a humanitarian mission, but an Israeli think tank reported that seven of the nine passengers killed had professed a desire to die as "martyrs" before the boat set sail to Gaza. Radical Muslim terrorists and their supporters often glorify the idea of martyrdom for Allah, achieved via jihad.

The Jerusalem Post cited the Intelligence and Terrorism Information Center which reported a month after the raid that eight of the nine passengers killed were members of the IHH, a Turkish group that calls itself humanitarian but which the Israeli government along with some U.S. and European lawmakers characterize as radical Islamist in nature. The State Department has not included the IHH on its list of terrorist groups.

According to the Israeli think tank report, a Turkish newspaper printed this quote from 19-year-old Furqan Dogan's diary, in which he said he wanted to be a martyr, providing strong evidence his intentions were not peaceful: "These are the last hours before I join the sweet experience of being a shahid (martyr). Is there anything more beautiful than this?"

On his visit to Israel in March, President Obama convinced Israeli Prime Minister Benjamin Netanyahu to issue an apology to Turkey for the killing of the flotilla activists and to offer financial compensation for those killed. In exchange, Turkey was supposed to promise to drop any legal suits against the Israeli servicemen involved.

Ever since the apology, Turkey has appeared to backtrack on the deal personally brokered by Obama. Earlier this week, lawyers for the Turks killed filed a complaint against Israel at the International Criminal Court (ICC) in The Hague. That venue is chosen when parties seek investigations of war crimes, genocide or crimes against humanity.

Officially, the suit was referred to the court by Comoros, a small African country in which the Mavi Marmara was registered. Michael Rubin of Commentary Magazine suggests Erdo?an wants "plausible deniability," that it's not the Turkish government filing the suit in defiance of Obama's request.

Rubin reveals that the law firm behind the ICC filing employs one principal who is "a long-time AKP party [Erdo?an's Justice and Development Party] activist and the other has been intimately involved in the IHH." Rubin writes:

Anyone who believes that Erdo?an seeks to bury that hatchet more than rub salt into the wounds of the last two years needs only to consider the special guest whom he has had join his delegation.[...]

It is actually quite amazing: Erdo?an has endorsed an Al Qaeda financier, embraced not only Hamas but the most militant faction within that terrorist organization, defended the Sudanese leader against charges of genocide, and has been the largest leak in multilateral efforts to sanction Iran. And yet, Obama will not only welcome him to the White House with the highest honors, but help fulfill the Turkish premier's blatant desire to use the White House as the backdrop to follow through on his pledge to bash Israel at every opportunity.

Erdo?an has already rejected a personal request from Secretary of State John Kerry to hold off on visiting the Gaza Strip. Positioned next to Obama, Erdo?an used the White House backdrop Thursday to announce the June timeframe for his trip to meet with Hamas leaders in Gaza, a group the U.S. defines as a terrorist organization.

At the press conference, Obama emphasized his strong relations with the Turkish leader. "This visit reflects the importance that the United States places on our relationship with our ally, Turkey, and I value so much the partnership that I've been able to develop with Prime Minister Erdogan," Obama said according to the White House transcript.

Just two days after Turkish citizens got the International Criminal Court to investigate a possible case against Israel, Obama took a moment to compliment Erdo?an for the steps he's taken to fulfill the arrangement Obama brokered between Israel and Turkey.

"Given our shared interest in peace, I want to note the Prime Minister's efforts to normalize relations with Israel," Obama said.

White? House Press Secretary Jay Carney said at his daily news briefing Tuesday, "Turkey is one of our strongest partners."

Besides meeting Obama, Erdo?an placed a foundation stone at a new Turkish-American cultural center in Maryland.

According to Hurriyet Daily News, Erdo?an said the center reflects the "alliance of civilizations."

"In a period marked by Islamophobia, this center will express the brotherhood showing how wrong [Islamophobia] is," he said.

Yesterday there was some pretty damning news for owners of Google's Nexus Q musical orb: confirmation that the device isn't supported in the current version of the its Play Music app. This much is undoubtedly true, and verified by many owners. What is less clear, however, is whether this really is the end of the road. All the signals may be there, but some readers have forwarded us emails received from Google Play Support advising that a fix for Nexus Q streaming is definitely on the way. We contacted Google directly, but it was unable to give an official statement on the issue, simply highlighting that the developer product never made it to commercial release, and as such can't promise either way. While I spend my free time writing and slaving away at our housework, she is planning fun outings or visiting friends from college. She can stay out until 5:00 a.m. and sleep in until noon if she wants to, and she often does. Hearing her recount all of the fun things she?s been doing makes me miss the days when I didn?t have so much responsibility.

My new co-worker is also extremely frugal. She makes practical choices and typically buys all of her?business clothes second-hand. A thrifty shopper, she frequently uses coupons and doesn?t try to impress others with material possessions. In fact, she carries a purse that she bought at the Dollar Store for something like $8. I had no idea that the Dollar Store sold purses and that is exactly what I find impressive; she always finds new and interesting ways to save without sacrificing style or function. To top it off, she is allocating all of her extra money toward repayment of her student loans. I love hearing updates and cheering her on as she aggressively kills off her debt. If only I could?ve been more like her at her age, I would?ve been?much better off.

Projecting my insecurities

Despite her obvious competency, I still have to stop myself from giving her unsolicited advice. It?s not that I think she needs it. On the contrary, I know that she?s making great decisions compared to many of her peers. But despite her ability to manage her finances quite well, I want to prevent her from making all of the tragic mistakes that I once made. I can?t help but project onto her wishes for my former self when I was 24 years old. If only I had someone around to smack some sense into me, maybe it would?t have taken me nearly as long to get my financial act together. There are so many things I should?ve done differently.

Can you imagine what it would be like to start adulthood over with a clean slate? Since my friend is so financially aware for her age, she has the opportunity to avoid many of the pitfalls and traps that young people entering the job market often fall into. Unfortunately,?my twenty-something former self is a perfect example of ?what not do do.? There is a plethora of advice I desperately needed in my 20?s, and watching her make all of the right decisions has forced me to come to term with my own mistakes. This got me thinking, ?What would I tell your former self, if I had the chance??

Start saving for retirement immediately. Due to the magic of compound interest, it?s beneficial for young people to start saving for retirement as soon as possible. I wish I would?ve started saving immediately so that I wouldn?t have to work so hard now to catch up.

Avoid debt like the plague. It?s tempting to buy designer clothes or a fancy car when you first start out. When I was her age, I definitely tried to impress others with?material possessions I couldn?t afford. In my early twenties, I ran up my credit cards too many times to count. Unfortunately, I punished myself this way many times before I matured enough to stop. I wish I would?ve lived within my means and spared myself the enormous burden of debt in the first place.

You don?t need a new car. When I was 23, I financed a $25,000 car that I definitely couldn?t afford. While?getting a new car proved to be fun and exciting, the payment that came with it became a huge burden. I wish I would?ve forgone the new car and kept the one I already had.

Live cheaply while you can. Saving as much money as possible before getting married or having children is an ideal way to start off adulthood. Creating your own safety net provides stability and creates peace of mind. I wish I would?ve lived cheaply while I had the chance. Now that I have a family, I have to work that much harder to save.

Your friends are probably broke. I remember seeing what my friends owned in my early twenties and being really confused. Did they really have that much more money than I did? The reality is that easily available credit makes it nearly effortless to enjoy a?lifestyle you can?t afford. Now that I?m older and wiser, I realize that the majority of people I know are making payments on most of their stuff. Knowing that fact in my twenties would?ve explained a lot!

It?s stressful knowing that I wasted so many years before getting serious about saving and investing. On the other hand, always looking backward can be counterproductive. Each day presents a new opportunity to make better choices, and I?m proud to be on the path to financial freedom.?It?s certainly better late than never. And, who knows? If I would?ve made better choices, my life might be completely different. The thought of a different life is terrifying, and I?m thankful that I had the opportunity to learn so many things firsthand. I?m glad for each lesson, even if I had to learn them the hard way.

The fact is, my co-worker is a smart and sophisticated young lady. She gets to start her adult life with a clean slate, but not everyone has that opportunity. Still, all is not lost. One thing I?ve learned is that it?s never too late to get your financial life in order.?After all, mistakes are only insurmountable if you insist on repeating them. I?ve made my share, and I?ve moved on. And I know that at this moment, I am exactly where I am supposed to be.

What's the most expensive one-way commercial flight with no buses, cars or trains taking you from one airport to the other? Jalopnik readers started booking and this is what they found.

I guess the most important lesson we learnt from this round is that you can actually spend the price of a new Subaru STI or a Mustang Convertible on a single 4,771 mile long flight starting from New York. Now imagine spending that amount on petrol, and see where it could take you!
